加快推行工程總承包的緣由和思考

黨的十九(jiu)大(da)報告指出,中國特色社(she)會主義進(jin)入新時代,我國經(jing)(jing)濟已由(you)高(gao)速(su)增(zeng)長(chang)階段轉(zhuan)向高(gao)質量發(fa)(fa)展階段,正處(chu)在(zai)轉(zhuan)變(bian)發(fa)(fa)展方式、優化經(jing)(jing)濟結構(gou)、轉(zhuan)換增(zeng)長(chang)動能的攻關期。對于(yu)我國建(jian)(jian)筑(zhu)業(ye)來(lai)說,其規模(mo)快速(su)擴張帶來(lai)的發(fa)(fa)展正在(zai)成為傳統建(jian)(jian)筑(zhu)業(ye)面(mian)臨的機(ji)遇和(he)挑戰,加快推(tui)行(xing)工程總承(cheng)包已成為建(jian)(jian)筑(zhu)業(ye)改革(ge)發(fa)(fa)展的重點任務。


加快推行工程總承包的(de)緣由


一(yi)(yi)、黨(dang)中(zhong)(zhong)央(yang)國務院(yuan)高(gao)度重視。2016年,《中(zhong)(zhong)共中(zhong)(zhong)央(yang)國務院(yuan)關于進(jin)一(yi)(yi)步加強城市(shi)規劃建(jian)(jian)設(she)(she)管理(li)工(gong)(gong)作的若干(gan)意見》提出(chu)“深化(hua)建(jian)(jian)設(she)(she)項目組織(zhi)實施方式(shi)改革(ge),推廣工(gong)(gong)程總承包制,加強建(jian)(jian)筑市(shi)場監管,嚴厲查處轉包和違法(fa)分包等行(xing)為,推進(jin)建(jian)(jian)筑市(shi)場誠信(xin)體系建(jian)(jian)設(she)(she)。”2017年,《國務院(yuan)辦公廳關于促進(jin)建(jian)(jian)筑業(ye)持(chi)續健康發展的意見》在(zai)完善(shan)工(gong)(gong)程建(jian)(jian)設(she)(she)組織(zhi)模式(shi)中(zhong)(zhong)提出(chu):“加快(kuai)推行(xing)工(gong)(gong)程總承包。”全面提出(chu)了加快(kuai)推行(xing)工(gong)(gong)程總承包的各項具體要求。


二、建筑業(ye)(ye)(ye)改革發(fa)(fa)(fa)展(zhan)的(de)(de)(de)重點任(ren)務。2006年(nian)以來(lai),建筑業(ye)(ye)(ye)總(zong)產值持續增(zeng)長(chang),連續6年(nian)超過20%。2015年(nian)增(zeng)速為(wei)(wei)(wei)(wei)2.3%,2016年(nian)回升(sheng)至7.1%,2017年(nian)達到10.5%,今年(nian)第一(yi)(yi)季度為(wei)(wei)(wei)(wei)13%,整個行業(ye)(ye)(ye)進入(ru)平穩發(fa)(fa)(fa)展(zhan)期。建筑業(ye)(ye)(ye)作(zuo)為(wei)(wei)(wei)(wei)國民經濟的(de)(de)(de)支柱產業(ye)(ye)(ye),存在著行業(ye)(ye)(ye)發(fa)(fa)(fa)展(zhan)方式(shi)(shi)粗放、監(jian)管體制(zhi)機制(zhi)不健全(quan)(quan)、工程(cheng)(cheng)建設組織(zhi)方式(shi)(shi)落后等問題(ti)(ti)。解決問題(ti)(ti)的(de)(de)(de)重點任(ren)務之(zhi)一(yi)(yi)是(shi)工程(cheng)(cheng)建設組織(zhi)模式(shi)(shi)的(de)(de)(de)完善改進。工程(cheng)(cheng)建設組織(zhi)模式(shi)(shi)的(de)(de)(de)主層面(mian)主要(yao)包(bao)括建設單位、工程(cheng)(cheng)總(zong)承包(bao)、全(quan)(quan)過程(cheng)(cheng)咨詢。打破人為(wei)(wei)(wei)(wei)分割及碎片化,責(ze)任(ren)層次(ci)更(geng)明晰,責(ze)權利(li)更(geng)統(tong)一(yi)(yi),培(pei)育(yu)總(zong)承包(bao)企(qi)業(ye)(ye)(ye)及與之(zhi)配套的(de)(de)(de)專業(ye)(ye)(ye)企(qi)業(ye)(ye)(ye),提升(sheng)企(qi)業(ye)(ye)(ye)核(he)心競爭力。


三(san)、符(fu)合工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)客觀規(gui)律(lv)。真(zhen)正的工(gong)(gong)(gong)程(cheng)(cheng)總承包(bao)符(fu)合工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)的客觀規(gui)律(lv),有(you)利于(yu)實現(xian)設(she)(she)(she)計、采購、施工(gong)(gong)(gong)等(deng)各階(jie)段工(gong)(gong)(gong)作(zuo)的深度融合和資(zi)源高(gao)效配置,提(ti)高(gao)工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)水平;有(you)利于(yu)提(ti)高(gao)工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)效益,組織統籌管理設(she)(she)(she)計、施工(gong)(gong)(gong)等(deng)力(li)量,降低管理成本,有(you)效控制投(tou)資(zi),實現(xian)工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)項(xiang)目利益和價值最大化;有(you)利于(yu)提(ti)升工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)質量安全,發(fa)揮工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)責任(ren)主體單一(yi)和技術管理優勢(shi),降低工(gong)(gong)(gong)程(cheng)(cheng)風險,確保工(gong)(gong)(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)質量安全和效益;從國(guo)際經濟看工(gong)(gong)(gong)程(cheng)(cheng)總承包(bao)能夠節省投(tou)資(zi)6%,縮(suo)短工(gong)(gong)(gong)期25%以上,更科學更合理進(jin)行工(gong)(gong)(gong)程(cheng)(cheng)總承包(bao)。


四、推動“一(yi)(yi)帶(dai)一(yi)(yi)路”走(zou)出去實(shi)(shi)施(shi)(shi)。目(mu)前(qian),我(wo)國有65家企(qi)業(ye)(ye)(ye)(ye)進入2017年(nian)度(du)全球最大(da)250家國際(ji)(ji)承(cheng)(cheng)包(bao)(bao)(bao)商(shang)榜(bang)單,國際(ji)(ji)業(ye)(ye)(ye)(ye)務(wu)占比13.9%,歐洲承(cheng)(cheng)包(bao)(bao)(bao)商(shang)平均74.9%,美國承(cheng)(cheng)包(bao)(bao)(bao)商(shang)49.6%。我(wo)國對外承(cheng)(cheng)包(bao)(bao)(bao)業(ye)(ye)(ye)(ye)務(wu)雖然遍布世界190多(duo)個國家和(he)地區,但(dan)80%以上(shang)的業(ye)(ye)(ye)(ye)務(wu)集中(zhong)在亞非等新興和(he)不(bu)發達地區。國際(ji)(ji)大(da)型承(cheng)(cheng)包(bao)(bao)(bao)商(shang)BOT(建(jian)設-經營-轉讓)、PPP(政府和(he)社會資本合作)項目(mu)占75%,中(zhong)國建(jian)筑業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)EPC項目(mu)及施(shi)(shi)工總承(cheng)(cheng)包(bao)(bao)(bao)項目(mu)分別占比44%和(he)36%,仍處于初級發展階段。因此,加(jia)快推行工程(cheng)總承(cheng)(cheng)包(bao)(bao)(bao),促進行業(ye)(ye)(ye)(ye)轉型升級,才(cai)能有效提升建(jian)筑業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye)的核心競爭力,在“一(yi)(yi)帶(dai)一(yi)(yi)路”大(da)背景(jing)下(xia),推動企(qi)業(ye)(ye)(ye)(ye)“走(zou)出去”戰略的實(shi)(shi)施(shi)(shi)。


加快(kuai)推(tui)行工程(cheng)總承包(bao)的思考


一(yi)、精準跟蹤及時總(zong)結。截至目(mu)前,已(yi)有近20個地方(fang)開始推行工(gong)程(cheng)總(zong)承(cheng)包(bao),不僅集中在(zai)化工(gong)、石(shi)油、冶金等工(gong)業工(gong)程(cheng),目(mu)前房屋建(jian)筑和市政基礎設(she)施(shi)工(gong)程(cheng)也在(zai)積(ji)極開展。通過已(yi)開展的工(gong)程(cheng)試點,精準跟進跟蹤,及時總(zong)結經(jing)驗(yan)教訓,少走(zou)彎(wan)路。


二、工(gong)(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)核心(xin)與工(gong)(gong)程(cheng)要求。工(gong)(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)的(de)推(tui)(tui)行(xing)在借(jie)鑒(jian)國際成熟通(tong)行(xing)先進做(zuo)法的(de)同時要結合(he)(he)中國國情。加(jia)快推(tui)(tui)行(xing)工(gong)(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)的(de)核心(xin)點是促(cu)進設計與施工(gong)(gong)深度融合(he)(he),而不是簡單疊加(jia)和大拼盤,要體(ti)現經濟、技術、組(zu)織、管理、協調等資源集成高效配(pei)置(zhi)。政(zheng)府投(tou)資工(gong)(gong)程(cheng)帶頭推(tui)(tui)行(xing)工(gong)(gong)程(cheng)總(zong)(zong)承(cheng)包(bao),裝(zhuang)配(pei)式(shi)(shi)建筑原則上應(ying)采用工(gong)(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)模(mo)式(shi)(shi),鼓勵(li)非政(zheng)府工(gong)(gong)程(cheng)推(tui)(tui)行(xing)工(gong)(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)。


三、政府規范服務(wu)引導推進。加(jia)快(kuai)完善工程總承包相關的招標(biao)投標(biao)、施工許可、竣工驗收及工程擔保、保險(xian)等制度規定,盡快(kuai)出臺(tai)管理辦(ban)法(fa)和合(he)同示范文本等。政府要(yao)審(shen)慎包容,市(shi)場(chang)準入更(geng)注重(zhong)市(shi)場(chang)選擇,具備設計或施工承包資質開展(zhan)工程總承包,更(geng)多(duo)交由市(shi)場(chang)選擇,有利于生產力(li)的發展(zhan)。加(jia)快(kuai)完善信用體系,完善全(quan)國(guo)建筑(zhu)市(shi)場(chang)監管公共服務(wu)平臺(tai),實現與國(guo)家信用信息數據(ju)共享(xiang)交換,建立建筑(zhu)市(shi)場(chang)主體黑名(ming)單制度,依法(fa)依規全(quan)面公開企業和個人信用記(ji)錄。另外,還要(yao)加(jia)強(qiang)事中(zhong)事后(hou)監管。


四、利益回避(bi)與(yu)(yu)責(ze)(ze)任(ren)關系(xi)。由于工(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)(bao)(bao)企業(ye)(施工(gong)企業(ye))與(yu)(yu)工(gong)程(cheng)咨詢等(deng)(deng)企業(ye)存在(zai)著(zhu)制(zhi)約(yue)關系(xi),因此,二者不可存在(zai)利益關系(xi)。按照總(zong)(zong)承(cheng)包(bao)(bao)(bao)負(fu)總(zong)(zong)責(ze)(ze)的原則,工(gong)程(cheng)總(zong)(zong)承(cheng)包(bao)(bao)(bao)單(dan)(dan)位(wei)要(yao)承(cheng)擔(dan)工(gong)程(cheng)質量(liang)安全、進度控制(zhi)、成本管理等(deng)(deng)方(fang)面的責(ze)(ze)任(ren),對(dui)建(jian)設(she)單(dan)(dan)位(wei)負(fu)總(zong)(zong)責(ze)(ze),分包(bao)(bao)(bao)單(dan)(dan)位(wei)按照合(he)同(tong)的約(yue)定(ding)對(dui)總(zong)(zong)承(cheng)包(bao)(bao)(bao)單(dan)(dan)位(wei)負(fu)責(ze)(ze),減(jian)少(shao)因責(ze)(ze)任(ren)不清對(dui)工(gong)程(cheng)質量(liang)安全生產的影響。企業(ye)在(zai)某(mou)方(fang)面能力不足時,要(yao)允許總(zong)(zong)承(cheng)包(bao)(bao)(bao)單(dan)(dan)位(wei)按照合(he)同(tong)約(yue)定(ding)經建(jian)設(she)單(dan)(dan)位(wei)同(tong)意,直接發包(bao)(bao)(bao)總(zong)(zong)承(cheng)包(bao)(bao)(bao)合(he)同(tong)中(zhong)涵(han)蓋(gai)的其(qi)他(ta)專業(ye)業(ye)務。利益和責(ze)(ze)任(ren)關系(xi)要(yao)注意防止轉(zhuan)包(bao)(bao)(bao)掛靠(kao),總(zong)(zong)包(bao)(bao)(bao)“包(bao)(bao)(bao)而不管”。


五、現有企業發展問題。在中國建筑業企業中,并不是所有的企業都具有工程總承包能力的,我們的企業多數不是大而全就是小而全,很少能夠達到專、精、實、細。未來企業的發展有兩種情況:一種是鼓勵龍頭建筑與工程設計企業(尤其是特級和大型工程設計企業)做優做強做大,另一種是大量專業特色鮮明的專業企業提升專業能力,做專做精做細做實。龍頭企業與專業企業開展合作,各取所長,優勢互補,避免同質化競爭,形成良好的行業生態。企業本身要找準定位,改變傳統人力資源(培養復合型人才)及傳統組織管理體系,提高技術與管理水平,增強企業核心競爭力。
